Fluff Bazaar Terms and Conditions

  1. Acceptance of Terms
    1.1: Welcome to Fluff Bazaar! These Terms and Conditions (“Terms”) govern your use of the Fluff Bazaar web and mobile application (the “App”) and any related services provided by Fluff Bazaar (collectively referred to as the “Services”). By accessing or using the App or Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App or Services.
  2. Account Registration
    2.1: In order to use certain features of the App and Services, you may need to create a user account. You must provide accurate, complete, and up-to-date information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  3. Pet Products and Services
    3.1: Fluff Bazaar provides an online platform for the purchase and sale of pet products and related services. The products and services offered on the App are provided by third-party vendors. Fluff Bazaar does not directly sell or manufacture the products and is not responsible for their quality, safety, or compliance with any applicable laws or regulations.

    3.2: Fluff Bazaar strives to provide accurate and up-to-date information about the pet products available on the App. However, Fluff Bazaar does not warrant the accuracy, completeness, or reliability of any product descriptions, prices, or other information displayed on the App. Any reliance on such information is at your own risk.

  4. Ordering and Delivery
    4.1: Through our adoption services, we strive to provide a beautiful home to pets through our NGOs and Rescue partners and rely on information provided by them on our platform. Fluff bazaar does not claim responsibility for accuracy of pets information and does not charge anything from those partners for pet’s adoption.

    4.2: When placing an order through the App, you agree to provide accurate and complete information, including the delivery address. Fluff Bazaar will make reasonable efforts to ensure the timely delivery of the ordered products, but cannot guarantee specific delivery times.

    4.3 In the event of any issues or discrepancies with your order, please contact Fluff Bazaar’s customer support within a reasonable timeframe for assistance.

  5. User Obligations and Conduct
    5.1: You agree to use the App and Services only for lawful purposes and in compliance with these Terms. You will not engage in any activities that may:

    5.1.1 Violate any applicable laws, regulations, or third-party rights.
    5.1.2 Infringe upon the intellectual property rights of others.
    5.1.3 Interfere with or disrupt the operation of the App or Services.
    5.1.4 Transmit any harmful or malicious code or content.
    5.1.5 Attempt to gain unauthorized access to any portion of the App, Services, or related systems.

  6. Intellectual Property Rights
    6.1: The App and Services, including all content and materials provided therein, are protected by intellectual property laws. You agree not to reproduce, modify, distribute, or create derivative works based on the App or Services without prior written permission from Fluff Bazaar.

    6.2: You retain any intellectual property rights that you hold in content you submit or post through the App. By submitting or posting such content, you grant Fluff Bazaar a non-exclusive, worldwide, royalty-free, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in connection with the operation and promotion of the App and Services.

  7. Limitation of Liability
    7.1 Fluff Bazaar shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App or Services, even if Fluff Bazaar has been advised of the possibility of such damages. This limitation of liability applies to the fullest extent permitted by law.

    7.2 Fluff Bazaar’s total liability for any claims arising under or related to these Terms shall not exceed the amount paid by you, if any, for using the App or Services during the six-month period preceding the claim.

  8. Indemnification
    8.1 You agree to indemnify and hold Fluff Bazaar and its affiliates, officers, directors, employees, and agents harmless from any claims, demands, losses, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising out of or in connection with:

    8.1.1 Your use of the App or Services; 8.1.2 Your violation of these Terms; 8.1.3 Your violation of any applicable laws, regulations, or third-party rights.

  9. Termination
    9.1 Fluff Bazaar reserves the right to suspend or terminate your access to the App or Services at any time, without prior notice, for any reason or no reason at all. Upon termination, these Terms will continue to apply to any previous use of the App or Services.
  10. Governing Law and Jurisdiction
    10.1 These Terms shall be governed by and construed in accordance with the laws of India, with the jurisdiction of the courts in Bangalore, Karnataka, India. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
  11. Modifications to Terms and Conditions
    11.1 Fluff Bazaar reserves the right to modify or update these Terms at any time. Any changes will be effective upon posting the revised version on the App. Continued use of the App or Services after any such changes constitutes your acceptance of the revised Terms.

Service Provider

By registering as a service provider on our website, you agree to the terms and conditions governing the use of our platform. These include providing accurate service details, maintaining confidentiality of customer and platform data, and adhering to all applicable laws. You must deliver services as advertised, described, ensuring quality and timeliness on our platform. The intellectual property you create remains yours unless otherwise agreed, but you grant us a license to use content related to your services. You also agree to indemnify us against any claims arising from your services and Fluffbazaar (Devnia Solutions OPC Pvt Ltd) is not accountable for any legal actions between you and customers. Termination can occur for breach of terms, and any disputes will be resolved as per the applicable laws. By proceeding, you confirm acceptance of these conditions and our policies

Rescuer

By posting a pet for adoption on our platform, you (the “Rescuer”) agree to the following terms and conditions:

  1. Accuracy of Information
    The Rescuer affirms that all information provided about the pet, including but not limited to health, behaviour, breed, and history, is accurate, true, and complete to the best of their knowledge. Any updates or changes to the pet’s condition must be communicated immediately.
  2. Ownership and Rights to Rehome
    The Rescuer confirms that the pet listed for adoption is not owned by any other individual or entity, and the Rescuer has full legal rights to place the pet for adoption. The Rescuer affirms that the pet has been lawfully acquired, and no third-party claims exist regarding the pet’s ownership.
  3. Responsibility for the Pet
    The Rescuer agrees to assume full responsibility for the pet they are posting for adoption, including ensuring the pet’s health, safety, and welfare prior to the adoption. The Rescuer acknowledges they will be solely responsible for any issues, disputes, or claims that may arise related to the pet’s ownership and health before or after the adoption process.
  4. Direct Communication and Documentation with Potential Adopters
    The Rescuer agrees to promptly contact any potential adopters who express interest in the pet. The Rescuer will handle all aspects of communication, vetting, and documentation directly with the adopter, including any contracts, legal paperwork, or other adoption documentation required to finalize the adoption process in a timely manner.
  5. Company Liability
    The Fluff Bazaar platform (the “Company- Devnia Solutions Pvt Ltd.”) acts solely as an intermediary for connecting potential adopters with rescuers. The Company is not responsible for verifying the accuracy of the information provided by the Rescuer or the suitability of the pet for adoption. The Company is not liable for any disputes, legal claims, damages, or losses that may result from the adoption process or from any issues related to the pet’s health, behavior, or ownership.
  6. Indemnification
    The Rescuer agrees to indemnify and hold the “Company” harmless from any and all claims, damages, liabilities, or expenses (including legal fees) arising from the posting of the pet for adoption, any misrepresentation of the pet’s condition or history, or any disputes related to the pet’s ownership or adoption.
  7. Compliance with Laws
    The Rescuer agrees to comply with all local, state, and federal laws regarding the adoption and rehoming of pets, including any required vaccinations, spay/neuter procedures, or health certifications.
  8. Termination and Removal of Posts
    The Company reserves the right to remove any pet listing without prior notice if it finds any violation of these terms or in case of any dispute regarding the pet’s ownership or condition.

By submitting a pet for adoption on our platform, the Rescuer acknowledges and agrees to these terms and conditions.

Adopting a Pet

By adopting a pet through our platform, you (the “Adopter”) agree to the following terms and conditions:

  1. Adoption Process and Documentation
    The Adopter agrees to follow all necessary steps in the adoption process, including completing any required documentation provided by the Rescuer or our platform. This may include, but is not limited to, an adoption application, a home inspection, sharing family and adoption details, and signing an adoption agreement. You agree to provide accurate and truthful information during the application process.
  2. Adoption Fee
    The Adopter understands that a small adoption fee of [quoted by rescuer as donation] is required to cover administrative and processing costs. This fee is non-refundable and must be paid before the adoption is finalized. The adoption fee helps support the rescue efforts and care provided to the pets during their time in foster care or the shelter.
  3. Vaccination and Sterilization Costs
    The Adopter acknowledges that pets adopted through the platform must be up to date on vaccinations and spayed/neutered.

    • Vaccinations:
      The Adopter is responsible for ensuring the pet receives all required vaccinations, if not done already. If the pet has not yet received vaccinations at the time of adoption, the Adopter agrees to cover the cost of any remaining vaccinations as required by local laws or health guidelines.
    • Sterilization:
      If the pet has not been spayed or neutered prior to adoption, the Adopter agrees to ensure to cover the costs of the sterilization procedure and to have it completed within a specified time frame, as agreed with rescuer.
  4. Health and Behaviour Disclosure
    The Rescuer has provided information on the health and behaviour of the pet to the best of their knowledge. The Adopter understands that any unforeseen health or behavioural issues may arise post-adoption. The platform and Rescuer cannot guarantee the future health or temperament of the pet, and the Adopter agrees to accept full responsibility for the pet’s care. To help with such situations, we advise to buy an insurance immediately.
  5. Pet Care and Responsibility
    By adopting, the Adopter agrees to provide the pet with a safe, loving, and permanent home. This includes, but is not limited to, ensuring proper nutrition, regular veterinary care, exercise, and a nurturing environment. The Adopter also agrees not to sell, rehome, or abandon the pet without first notifying the Rescuer and giving them the opportunity to reclaim the pet.
  6. Indemnification
    The Rescuer agrees to indemnify and hold the “Company” harmless from any and all claims, damages, liabilities, or expenses (including legal fees) arising from the posting of the pet for adoption, any misrepresentation of the pet’s condition or history, or any disputes related to the pet’s ownership or adoption.
  7. Return Policy
    Should the Adopter be unable to keep the pet for any unforeseen situations, they agree to contact the Rescuer to arrange for the safe return of the pet. The pet must not be surrendered to a shelter or sold to another party without first notifying the Rescuer.
  8. Compliance with Laws
    The Adopter agrees to comply with all local, state, and federal laws relating to pet ownership, including any requirements for licensing, vaccinations, and pet care.
  9. Non-Transferable Ownership
    The pet’s ownership is transferred solely to the Adopter upon completion of the adoption process. The adoption agreement is non-transferable, and the Adopter agrees that they are the legal owner of the pet once the process is completed.
  10. No Liability for Platform
    The platform, Fluff Bazaar, serves solely as a facilitator between the Rescuer and the Adopter. The platform is not responsible for the health, behaviour, or future care of the pet and shall not be liable for any disputes arising from the adoption process.

By requesting for a pet for adoption on our platform, the adopter acknowledges and agrees to these terms and conditions.
